By accessing or using the Reclaim Bharosa platform ("Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Platform.
You must be at least 18 years old and have the legal capacity to enter into this agreement. By using our Platform, you represent that you meet these requirements.
Legal Compliance: These Terms are governed by Indian law, including the Consumer Protection Act, 2019, Digital Personal Data Protection Act, 2023, Information Technology Act, 2000, and other applicable Indian laws.
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms, subject to any requirements for fresh consent under applicable laws.
2. Description of Service
Reclaim Bharosa is an insurance claim assistance platform. We provide the following services:
- New Claims Filing Assistance: Help with filing new insurance claims
- Rejected Claims Appeal Support: Assistance in challenging rejected claims
- Delayed Claims Expediting: Help expedite pending claims
- Short Settlement Recovery: Support for recovering full claim amounts
- Consultation and Document Preparation: Expert guidance and document preparation
- Case Management and Tracking: Tools to track your claim status
Important: Reclaim Bharosa is an insurance claim assistance consultant. We are NOT an insurance company, law firm, or financial advisor. We act as an intermediary to help you with your insurance claims.
3. User Accounts and Registration
3.1 Account Creation
To use certain features of our Platform, you must create an account. Account creation requires:
- Valid email address
- Email verification via OTP
- Azure AD account creation
- Accurate and complete information
- Consent to our Privacy Policy and data processing practices
Data Protection: By creating an account, you consent to the collection and processing of your personal data as described in our Privacy Policy, which complies with the Digital Personal Data Protection Act, 2023.
3.2 Account Responsibilities
You are responsible for:
- Maintaining the security of your account
- Not sharing your credentials with others
- Notifying us immediately of unauthorized access
- Keeping your contact information updated
- All activities that occur under your account
3.3 Account Termination
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Provide false or misleading information
- Abuse the Platform or other users
You may close your account at any time by contacting us.
4. User Conduct and Prohibited Activities
You agree NOT to:
- Provide false, misleading, or inaccurate information
- Upload malicious files, viruses, or harmful code
- Attempt to gain unauthorized access to the Platform
- Interfere with or disrupt Platform operations
- Reverse engineer, decompile, or disassemble the Platform
- Scrape, crawl, or harvest data from the Platform
- Impersonate others or misrepresent your identity
- Violate any applicable laws or regulations
- Use the Platform for any illegal or unauthorized purpose
Violation of these rules may result in account suspension or termination, and legal action if necessary.
5. Service Limitations and Disclaimers
5.1 No Guarantee of Results
We cannot guarantee:
- That your claim will be approved by the insurance company
- That you will receive any specific claim amount
- The timeline for claim resolution
- That insurance companies will accept our recommendations
Results vary based on individual cases, policy terms, and insurance company decisions. Insurance company decisions are final and binding.
5.2 Service Availability
We strive to maintain Platform availability but:
- We do not guarantee uninterrupted or error-free service
- Scheduled maintenance may occur
- Third-party service dependencies may affect availability
- We are not liable for service interruptions
5.3 AI Assistant Disclaimer
Our AI assistant provides informational guidance only. It is:
- NOT a substitute for professional legal or financial advice
- May contain inaccuracies or errors
- Should not be relied upon for critical decisions
- Subject to limitations and may not cover all scenarios
Please verify important information independently and consult licensed professionals for complex matters.
6. Fees and Payment
6.1 Fee Structure
We operate on a "No Win, No Fee" model:
- You pay NO upfront costs
- Fees are only charged upon successful claim recovery
- Fee structure will be disclosed before you commit to our services
- Payment terms and methods will be communicated separately
6.2 Refund Policy
Refund conditions, if applicable, will be communicated at the time of service agreement. Please contact us for specific refund policies.
7. Intellectual Property
7.1 Platform Ownership
All content, design, code, trademarks, and logos on the Platform are owned by Reclaim Bharosa or our licensors and are protected by copyright and trademark laws.
7.2 User Content
You retain ownership of documents and content you upload. By uploading content, you grant us a license to:
- Use the content for service delivery
- Store and process the content
- Share with insurance companies as necessary for claim processing
We reserve the right to remove inappropriate or illegal content.
8. Limitation of Liability
8.1 Disclaimer
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
8.2 Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Insurance company decisions or actions
- Third-party service failures
- Force majeure events
8.3 Maximum Liability
Our total liability shall not exceed the fees paid by you for our services in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Reclaim Bharosa, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any laws or regulations
- Content you upload or submit
10. Dispute Resolution
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, including:
- Consumer Protection Act, 2019
- Digital Personal Data Protection Act, 2023
- Information Technology Act, 2000
- Indian Contract Act, 1872
- Other applicable Indian laws and regulations
These Terms shall be interpreted without regard to conflict of law principles.
10.2 Jurisdiction
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
Consumer Disputes: For consumer disputes, you may also approach the appropriate Consumer Disputes Redressal Commission (District, State, or National) under the Consumer Protection Act, 2019.
10.3 Dispute Process
In case of disputes:
- Parties shall attempt good faith negotiation
- If negotiation fails, parties may seek mediation
- For consumer disputes, parties may approach Consumer Forums
- As a last resort, parties may pursue legal action in the courts of Mumbai
Data Protection Disputes: For disputes related to data protection under DPDP Act, please refer to our Privacy Policy and Grievance Policy for the specific process, including the right to appeal to the Data Protection Board.
11. Termination
11.1 By User
You may stop using the Platform at any time. You may close your account by contacting us. Data retention policies apply after account closure.
11.2 By Company
We may terminate or suspend your access to the Platform:
- For violation of these Terms
- For fraudulent or illegal activity
- At our discretion, with or without notice
12. Modifications to Service
We reserve the right to:
- Modify or discontinue features of the Platform
- Change service offerings
- Update technology and infrastructure
We will notify you of material changes. Your continued use after changes constitutes acceptance.
